Mass Action and Attorney's Fees

The following description is just an example, and is not necessarily representative of what would happen in any particular case.

A mass action will, generally, take more time to prosecute than a single client case. This is not absolute, however, because some single client cases are extremely work intensive. While it generally takes more time to prosecute a mass action than a regular lawsuit, there are a lot of costs that are not duplicated as many, if not all, of the arguments are duplicated.

As such, if it takes twice the time to prosecute a 100-person mass action versus a 10-person mass action, and twice the time for a 10-person as a single-person action, the individual cost for attorney's fees is greatly reduced for the 100-person mass action versus a 10-person mass action versus a single-person action.

For example, if a 10-person mass action pays $30 per hour for attorney work, it is cheaper than one person paying $300 per hour, even if it takes twice as long to complete the same task (i.e. $60). In a 100-person mass action, $3 per hour for attorney's work is cheaper than $30 per hour for a 10-person mass action, even if it takes twice as long to accomplish the same amount of work ($6).
