An Example of Reduced Property Value Resulting in Foreclosure Litigation

Assume a lender fraudulently executes an "Assignment," assigning a loan that it has no rights to, to itself or to a related entity. The bank then uses that assignment to foreclose on a neighboring property.

In this scenario, the bank or servicer KNOWS it has fraudulently assigned a loan. Will the bank want to keep the home, and the risk the sale is undone, on its books? Or will it want to find some investor willing to buy the home at a discount, an investor willing to take the risk?

In Arizona, an investor who buys the home at a steep discount has a two- or three-year period (depending on which statute the courts apply — ARS 12-522 or ARS 12-523) before they are free and clear of any backlash.

If the investor buys the home at a discount, this lowered home value becomes part of your neighborhood's valuation. If this situation happened here, your home value may have plummeted because the bank did not want the added risk of a sale being undone.
